Download Terms

These Burberry video conference background download terms (the “Download Terms”) govern your use of the Burberry video conference backgrounds made available for download by Burberry (the “Backgrounds”). These Download Terms are subject to and include the Burberry.com Terms, which are fully incorporated by reference (click here to read in full). Any terms not defined herein shall have the meaning given to them in the Burberry.com Terms.

By downloading the Backgrounds you agree to the Download Terms. If you do not agree to these Download Terms, you must cease download and use of the Backgrounds immediately. The Download Terms may be changed and updated from time to time and any changes will be effective from the publication of the new Download Terms on the Platforms.

1. Use of Backgrounds

Subject to the terms herein, we grant you a revocable, and non-exclusive licence to access and make personal use of the Backgrounds limited such that it does not include the right to:

(A) use the Backgrounds in any way which may prejudice or damage the reputation of Burberry; 

(B) use the Backgrounds for any commercial or business purposes. The Backgrounds are for your personal use only; 

(C) use software robots, spiders, crawlers, or similar data gathering and extraction tools, or take any other action that may impose an unreasonable burden or load on our infrastructure.

Burberry may in its sole discretion and at any time, without prior notice, restrict your availability of the Backgrounds or otherwise terminate the limited licence set forth above without prejudice to any other remedy we may have against you pursuant to applicable law for any reason whatsoever and/or for any breach of these Download Terms.

2. Intellectual Property

The Backgrounds shall form part of the Content and contain Burberry owned or licenced Trade Marks or other Intellectual Property and are and remain the exclusive property of Burberry and/or its licensors and are protected by all applicable laws and treaties around the world. All such rights are reserved.

3. No Warranties.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURBERRY DISCLAIMS AND EXCLUDES ALL TERMS, CONDITIONS AND WARRANTIES IN RELATION TO THE BACKGROUNDS WHETHER EXPRESS OR IMPLIED BY STATUTE OR OTHERWISE OR ARISING FROM ANY PREVIOUS COURSE OF DEALING OR USAGE OR TRADE PRACTICE.
